Supreme Court rules Biden can end the ‘Remain in Mexico’ program

Supreme Court Ruling
In a recent ruling, the Supreme Court of the United States has ruled that Migrant Protection Protocols, the Trump-era policy that forces asylum seekers to wait in Mexico while they await the hearings to adjudicate their claims for refuge in the United States, can now be terminated by the Biden administration. The Biden administration had made plans to phase out and end the program along with the Title 42 policy entirely by May 2022, however Republican states who opposed the termination of the immigration programs and policies sued for them to continue. As a result, a federal judge issued an injunction to the Biden administration to stop the policies from ending.
Challenging this injunction, the Biden administration took the federal judge’s ruling all the way to the Supreme Court. In a ruling of 5-4, the Supreme Court ruled that the Biden administration has the power and discretion to end the program while legal claims brought forth by opposing federal states are being considered in the federal courts.
What will happen next?
Since taking office, President Biden has been trying to reverse controversial policies implemented by his predecessor, Donald Trump. However, when it comes to overturning controversial immigration programs and policies at the southern border, the Biden administration has been met with several obstacles. Republican-led federal states who believe the ‘Remain in Mexico’ program and Title 42 (the pandemic-era policy that automatically turns away asylum-seekers at the border based on the assumption that they were exposed to a communicable disease like COVID-19) curb both illegal and legal immigration are fighting hard to keep the immigration policies in place.
However, this recent Supreme Court ruling shows promise that the Biden administration can overturn not only the ‘Remain in Mexico’ program but soon the Title 42 policy despite any legal challenges from conservatives who want the controversial immigration practices to continue.
