    A British citizen has the right to abode in the UK, meaning they can travel, live and work in the UK without a visa or work permit. You may travel at any time and do not need to notify any authority, but there are important things to note before about your immigration status.

    When returning to the UK from the US this year, ensure you travel on a British Passport even if you have dual citizenship. If your British passport has expired while you were living in the US, renew it before you travel. A US passport won’t get you through eGates at Heathrow.

    Does an American Spouse Need a Visa to Live in the UK?

    Yes, marrying a British citizen does not automatically give an American spouse the right to live in the UK. If you are a British citizen married to an American, your spouse must apply for and be granted a UK spouse visa before they can return with you to the UK.

    US citizens may only visit the UK for up to six months without a visa and they can not switch to a different visa category from within the UK as a visitor. They will require an electronic travel authorization (ETA) before travelling.

    You do not have to already be living in the UK to sponsor your spouse for a Spouse visa. You can return to the UK at the same time as your spouse, once their application has been granted.

    Applications from outside the UK can take up to 12 weeks or longer to process. It is important not to make any travel plans or permanent relocation decisions until their visa has been approved.

    What Are the Eligibility Requirements for a UK Spouse Visa?

    American spouses of British citizens applying for a UK Spouse Visa must meet certain eligibility criteria to ensure a successful visa application.

    Both the applicant and sponsor (British citizen) have a role to play in meeting the following eligibility requirements.

    Suitability Requirement

    Applicants for the UK spouse visa must not have a significant criminal record, be subject to a deportation order, or have previously breached UK immigration rules. The Home Office will consider your suitability during the application process.

    Intention to Live Together Permanently

    You and your British spouse must intend to live together permanently in the UK. If the Home Office has any doubts about whether a couple intends to move permanently to the UK, it may affect the outcome of your application.

    Financial Requirement

    British citizens sponsoring their American spouses must earn at least £29,000 gross per year either from employment, self-employment, or certain non-employment sources.

    This minimum financial threshold has been effective since April 2024, but it is currently undergoing a review with the Migration Advisory Committee and may change later in the year. Always confirm recent updates on the official government website before submitting your application.

    If your income does not meet the current minimum threshold, you may use cash savings above £16,000 to increase your financial eligibility. However, this is calculated differently and if you want to rely purely on cash savings, the total amount required will be £88,500, to be held for six months or more.

    Relationship Requirement

    You must have been legally married, in a recognised civil partnership, or in a genuine unmarried partnership with a British citizen, and be able to demonstrate that the relationship is genuine and subsisting (i.e., currently ongoing and active with evidence of shared life together). This is the most common reason for UK Spouse Visa refusals, and it is important that you are able to provide detailed and sufficient evidence to help strengthen your application.

    Accommodation Requirement

    You must have adequate accommodation arrangements for your stay in the UK. The property you choose to stay may be rented, owned, or provided by another family member, but it must meet UK housing standards and not be overcrowded when everyone finally moves in. Always include evidence of the accommodation such as tenancy agreement or property deeds in your application.

    English Language Requirement

    Since you are an American citizen applying for the UK Spouse Visa, you are automatically exempt from the English language requirement and do not need to sit for a language test.

    What are the Documents Required for a UK Spouse Visa Application?

    • A valid US passport (for the applicant)
    • A valid British passport (for the sponsoring spouse)
    • A certified, original copy of your marriage certificate. If it is not originally written in English, it must be translated using certified translation services

      What Kind of Visa Do Children Need When Returning to the UK from the US?

      The right Visa route depends on the children’s British citizenship status. There are two important categories to consider:

      Children Born in the US to a British Parent

      If your child was born in the US to a British citizen parent, they may be eligible for automatic British citizenship by descent and will not need to apply for a visa. They only need a British passport, which can be applied for at a British consulate in the US.

      A child can not automatically acquire citizenship by descent if the British parent also acquired their own citizenship by descent (i.e., they were born to a British parent abroad). Only British parents who acquired their UK citizenship by birth, adoption or decree can automatically pass on their citizenship to a child born abroad.

      However, British parents who acquired citizenship by descent will still be able to register their child after three years of continuous residence in the UK.

      If you are unsure whether your child is eligible for British citizenship, check your position at the official government website. If he/she isn’t eligible, you’ll have to apply for a child dependent visa under the family visa route.

      Non-British Children

      Your child will need a visa since they are not British citizens. He or she is eligible to apply if:

      • They are not yet 18 years old
      • They are not living independently and not married
      • Both parents are relocating to the UK, or one parent holds a UK visa or British citizenship

      If only one parent is relocating, you will need to provide strong evidence and a written consent from the non-relocating parent to ensure a successful application.

      There is no separate financial threshold for children as they are already covered by the sponsor’s financial eligibility.

      However, parents are still required to pay the IHS child dependent visa application fee of if they are applying separately and not included in your Spouse Visa application.

      What Are the Other Available Routes for Unmarried Partners of British Citizens?

      If you and your American partner are not yet married, but have been living together and plan to relocate as a couple to the UK, here are other alternative routes you might want to consider.

      Fiancé(e) Visa

      If you are already engaged and plan to marry each other in the UK, your American partner may be eligible for a fiancé(e) visa. This visa is valid for six months. You can come to the UK on this visa to get married to your British citizen/resident partner within six months.

      You must apply for a spouse visa as soon as you get married.Switching to the UK spouse visa route must be done from inside the UK. Your partner will not be eligible for paid work in the UK until they have successfully switched to a Spouse Visa.

      Unmarried Partner Visa

      If you have been living together with your American partner for at least two years, they may be eligible for an unmarried partner visa. This visa has the same financial, accommodation, and relationship requirements as the UK Spouse Visa but applicants must be able to provide strong evidence of cohabitation.

      Proving “shared life together” may be harder for unmarried couples.

      This simply means they will be made to travel on a separate cargo handled by the airline, and not through the passenger flight.

      However, not all airlines carry pets as cargo so it is important to research ahead of your travel date, especially if you have a large dog.

      Approved Border Control Posts

      Your pet must arrive in the UK through an approved Border Control Post (BCP). London Heathrow serves as the primary point of entry for all pets arriving as cargo from the US. On arrival, your pet will be inspected at the Animal Reception Centre by Border Force Animal Health before it can be released to you.

      This process takes time and requires a lot of patience. Do not expect to have your pet returned immediately after you retrieve your luggage at the arrivals hall. The Animal Reception Centre operates on its own schedule and will only release your pet after a successful inspection.

      Complete and Accurate Paperwork

      Your pet may face quarantine or be completely refused entry if any part of its paperwork is incorrect, missing, or not properly carried out. Follow each step for UK pet importation carefully, and ensure accurate and complete documentation before your pet travels.

        Step-by-step Guide for Bringing Pet Dog and Cat into the UK

        Travelers must carefully follow each step of the UK pet importation because the sequence and timing matters. The slightest omission at any stage will require you to begin the process again.

        To bring your pet dog or cat into the UK from the US, follow this step-by-step guide.

        Step 1: Microchip your pet

        Your dog or cat must be fitted with an ISO-compliant 15-digit microchip (according to ISO standards 11784 and 11785). This must be done before the rabies vaccination, not after. If the microchip is implanted after the vaccination, the vaccination is considered invalid and you will be required to repeat the process.

        If your pet already has a microchip that is not compatible with ISO standards, speak to your vet about implanting an additional ISO-compliant chip alongside the existing one.

        Step 2: Rabies vaccination

        After your pet has been microchipped, it will need to receive a rabies vaccination. Your pet must be at least 12 weeks old to be eligible for vaccination and it must be vaccinated at least 21 days before their arrival in the UK.

        This is the minimum number of days required for new vaccinations, and it cannot be shortened under any circumstances, so it is important to plan and begin the process early. If your pet has been previously vaccinated for rabies after microchipping and the vaccination is still valid, you will not need to wait for 21 days.

        Step 3: Get a Great Britain Pet Health Certificate

        Your pet dog or cat will need this for entry into the UK and be mandated to travel with it at all times. It must be completed by a USDA-accredited veterinarian and endorsed by USDA APHIS before your pet can travel.

        The health certificate has a short validity window, so it is necessary to confirm the exact timeframes with DEFRA and USDA APHIS before booking your pet’s travel date.

        Step 4: Get a Tapeworm treatment

        This treatment applies to dogs only, and is not required for cats. Your dog must be treated for tapeworm by a vet within 24 and 120 hours before arrival in the UK, and it must be recorded on the health certificate.

        This window is specific. If you begin too early or too late, the treatment becomes invalid, and your pet will not be allowed to enter the UK. It is important to begin planning early so it doesn’t affect your dog’s scheduled arrival at Heathrow.

        Step 5: Book manifest cargo space

        Three Months Before Departure

        Compile all documents required for your family’s visa applications and find a good USDA-accredited vet to help complete your pet’s health certificate.

        One Month Before Departure

        Track progress on your family’s visa applications, book your pet’s cargo space on the airline and confirm your UK-based pet customs clearance agent.

        Also begin the health certificate process with your vet at this stage so they have sufficient time for USDA APHIS endorsement.

        Twenty-four to 120 Hours Before Departure (Dogs Only)

        Have a pet administer tapeworm treatment to your dog at least 24-120 hours before booking any flights.

        Make sure your pet health certificate is USDA-endorsed and confirm your cargo space reservation again.

        Day of Travel

        A copy of your pet’s health certificate must travel with it on the cargo. Also keep a copy with your own visa documents.

        Most importantly, confirm pick-up arrangements at the Animal Reception Centre at Heathrow to prevent further delay.

        What Happens When You Arrive at the UK Border?

        When you arrive at the UK borders as a British citizen, you can freely use the eGates without the need for further questioning by border control officers. This also applies to your British children.

        Your spouse must, however, present their passport and visa (or eVisa status) at UK border control. If granted entry on a spouse visa, they will have full right to work from the date of entry. Your non-British children will also be admitted at the manual control.

        Your pet dog or cat will be held at the Animal Reception Centre at Heathrow for document verification. They will be released after all paperwork has been cleared. This process takes several hours and requires a lot of patience.

        The UK Spouse Visa has an initial validity of 33 months (two years and nine months ) if you applied outside the UK, but your spouse will have the full right to work from their first day in the country. The visa can be renewed for another 30 months through the FLR(M) extension route.
