Political pressure to give TPS to Ukrainian nationals
Ever since Russian forces invaded neighboring Ukraine in the early hours of February 24th, 2023, an estimated 500,000 Ukrainian nationals have fled to safety to neighboring Poland, Hungary, Moldova, and Romania. The European Union (EU) estimates that a further 4 million Ukrainian nationals will try to flee as the fighting intensifies.
As a result of this displacement due to war, many immigration advocates (including the two former heads of USCIS), as well as lawmakers, are pressuring the Biden administration to offer Temporary Protected Status (TPS) to any Ukrainian nationals who are currently in the United States. This status would grant Ukrainian citizens who are in the United States under non-immigrant visas the permission to remain in the United States and not be forced to depart to a nation that is currently under Russian military siege.
What can TPS do for Ukrainian citizens who are in the United States now?
The Migration Policy Institute estimates that there are about 30,000 Ukrainian nationals that are currently in the United States under a non-immigrant business or student visa. Some have even overstayed their visa leaving them undocumented.
If given TPS, these nationals will be able to stay in the United States without fear of deportation for a temporary amount of time. Nationals in the U.S. under TPS are even allowed to work after applying and receiving an Employment Authorization Document (EAD).
Many advocates and lawmakers believe this would further help the people of Ukraine in their fight against the Russian invasion. President Biden has already condemned the military actions of Russia against Ukraine as ‘an unprovoked and unjustified attack’. To further show their support for the people of Ukraine, the U.S. government has announced a series of economic sanctions aimed against the Russian federation in addition to releasing $350 million worth of weapons to Ukraine for aid in their military defense.
How does TPS work?
Under the Immigration and Nationality Act (INA), Temporary Protected Status (TPS) is granted by the secretary of the Department of Homeland Security (DHS) to nationals from countries affected by armed conflict, natural disaster, or any other extraordinary circumstances that can prevent a foreign citizen from safely returning to their home country.
Currently there are an estimated more than 400,000 individuals in the United States who are in the country under TPS. These include foreign nationals from El Salvador, Haiti, Sudan, Syria, and Venezuela.TPS is normally granted in periods of 6-18 months with extensions granted on a recurring basis by DHS. All applications for TPS must be accepted by the United States Citizenship and Immigration Services (USCIS).
