Citizens of foreign countries who wish to enter the United States must first obtain a visa. This stamp is placed in the traveller’s passport, and allow its holder to stay in the country for a fixed period of time, either for visit, study or work in the U.S.
The U.S. uses a point-based system to categories immigrants and travellers. Applicants’ eligibility is based on several factors, such as their nationality, personal background and work experience.
If you wish to relocate to the U.S., one of our experienced immigration attorneys can assist you with your application. Together, you will investigate your options to enter the United States, based on your needs and your qualifications.

U.S. Visas
Based on their circumstances, migrants who wish to enter the U.S. can apply for one of the following visas:
Work Visas
U.S. borders are usually open only for highly specialized workers. Foreign nationals can either apply for an immigrant work visa, which is for those who hold an advanced degree, or for a nonimmigrant visa, which only allows a temporary stay in the U.S.
Family-based Visas
Immediate Relative Immigrant Visas
These visas are based on close family members of U.S. citizens or permanent residents, such as spouses, unmarried children or parents.
Family Preference Immigrant Visas
These visas are for more distant family members of U.S. citizens and permanent residents, such as married sons and daughters, and brothers and sisters.
Visitor Visas
B-1 Visa for Business Visitors
This permit can be used to enter the U.S. temporarily for business purposes, such as attending a business convention or negotiating a contract.
B-2 Visa for Tourism
Those who wish to enter the U.S. for recreational purposes, such as visiting friends or receiving private medical treatment, need to apply for a B2 Visa.
Student Visas
F Visa
The F1 Student Visa is for international pupils who wish to attend a full course of study at any college, university or high school in the U.S.
The M1 Student Visa is for those who wish to attend a vocational non-academic course for a limited period.
F1 and M1 visa holders may also apply for their dependents to join them in the US while they study. These visas are the F2 dependent visa and M2 dependent visa.
U.S. Visa categories
Based on U.S. immigration law, there are two categories of visas:
- Immigrant Visas. These visas are issued only to those who are eligible for living permanently in the U.S. At the end of their authorized stay, migrants may be able to become lawful permanent residents.
- Nonimmigrant Visas. These permits are for those who wish to enter the UK only temporarily. As a part of their application, migrants will need to prove their intention of going back home as soon as their visa expires.
Traveling to the U.S. without a visa
Nationals of certain foreign countries can travel to the U.S. without a visa. This scheme is known as the Visa Waiver Program (VWP), and it is only open for nationals of countries who signed specific agreements with the United States.
Eligible applicants are admitted into the country for up to 90 days, but only for business or pleasure purposes. Those who wish to remain in the U.S. for a longer time, will still need to apply for a visa, regardless of their nationality.
