Resident Labor Market Test
The Resident Labor Market Test (RLMT) is a necessary procedure, undergone by all UK employers when hiring from overseas. The only exception to this rule is when the vacant job is listed on the UK Shortage Occupation List – in which case the RLMT is bypassed.
The RLMT ensures that roles advertised to overseas talent cannot be filled with residential candidates. In this case, ‘residential’ means EEA or UK. The RLMT guidelines state that a job should be advertised on a regulated platform, for 28 days. Then, it can be offered to non-EEA (including the US) candidates. If you are looking to migrate from the US to the UK for work in a skilled Tier 2 or Tier 5 role, you will most likely be affected by the RLMT. You will not need to undergo any process as part of the RLMT. This is due to the fact it is the employer’s responsibility. However, you may be affected indirectly by the RLMT. This is because jobs which are not in shortage are more scarce and competitive for international candidates.
